Investigating and building your case

This includes contacting the insurance companies, gathering evidence, interviewing witnesses, and starting to compile the Demand Packet.

Settlement or File a lawsuit

Once you have been released by your doctors, we compile a Demand Packet.

This includes everything related to your claim.

Insurance adjusters look for “value drivers” in evaluating claims. This includes medical treatment records, medical bills, and proof of lost income.

After discussing an initial settlement demand with you, we send the insurance company the demand packet, and start negotiations.

If the insurance company is not offering a fair settlement, the next step is to file a lawsuit. The vast majority of personal injury cases that are filed end up settling. 

Settlement

The “Settlement Phase” can occur anytime after the initial demand, and all the way up to trial. Based on our experience, our attorneys will tell you if we think the settlement offer is fair, but the final decision to decline the offer, or go to trial is up to the client. Likewise, your attorney can tell you that the case is worth more, but if you’d prefer to settle at the current offer, the decision is yours to make. 

Once a settlement agreement is reached, the “post settlement” phase commences. This includes reverifying all medical liens and bills, and negotiating with the providers and health insurance companies to increase the net recovery to the client. All liability insurance companies will require a signed Settlement Release before issuing the settlement checks. You should also expect to signed a Settlement Summary provided by your attorney that details the exact breakdown of everything. This includes the total amount recovered, attorney’s fees and litigation costs, what medical bills are paid, and what payments are made to reimburse your health insurance company, and the total net payment to the client.

Litigation Discovery Phase

This is where both sides “do their homework” to find out everything about the case. The insurance company and your attorney will issue “Discovery.” This will include interrogatories (written questions), requests for admissions, and requests for productions of documents. Both sides will also take depositions.

Mediation

Most judges in Oklahoma require the litigants in personal injury cases to attend a mediation. The mediator is paid by each party to the case and his or her job is to find a middle ground, or compromise dollar amount that the parties can agree to settle the case for.

Trial

If the case can’t get settled, a trial takes place to find out “what the case is worth.” Most personal injury cases in Oklahoma are tried in front of a jury.

T. David Hasbrook

 

David attended the University of Oklahoma and obtained his undergraduate degree in Psychology in 1975 and his law degree in 1978. He then served over four years on active duty with the United States Army as a lawyer in the Judge Advocate General’s Corps. During this period, he gained valuable trial experience. After leaving active duty in 1982, David continued his military career in the United States Army Reserves until 2006, when he retired at the rank of Colonel.
